No specific amount of images per shoot can be given. However, RFND always strives to provide as many as possible for every shoot. All images, that RFND have carefully selected and chosen, are professionally edited with licensed software. All images will be transferred to clients in the best preferred way. Should you wish to arrange a different way of receiving your images or videos, for example like a CD or a flash drive, special arrangements can be made to accommodate for them. These methods are not recommended due to data loss and RFND always recommends online media backed up media.

TO ALL RFND CLIENTS, NO RAW MEDIA WILL BE PROVIDED TO ANY CUSTOMER. The customer will only receive the chosen and edited images. No refunds will be provided. Should you be unhappy, RFND will supply a picking list, where the client may view and choose their images.

For detailed pricing options, please refer to the RFND Realty pricing catalog provided by the photographer. A fee of R300 will apply to bookings made on weekends. For staging, please contact RFND Realty for a quote. A R550 penalty fee will be charged for decluttering properties. This is due to the heavy time consumption caused by clutter. RFND Realty has a strict policy of photographing clean and staged properties. Agents or agencies will be provided with a property checklist to in order to help the agent and occupant better prepare for the booking.

Listings are strictly the responsibility of the agent and occupants. RFND Realty is not responsible for free cleaning and staging. Penalty fees will apply! Properties that extremely damaged, broken, or hoarded will only receive standard images. No discounts will apply.

FULL SPECIFIED TERMS AND CONDITIONS FOR REFINED PHOTOGRAPHY CLIENTS

By booking your shoot and paying your booking confirmation fee, the client agrees to the photo session terms and conditions. A 50% deposit is required in order to book events, or weddings and counts as your booking fee to secure your date. Deposits are not refundable, please refer to cancellation section for more info. All “full day” packages also require a 50% deposit in order to save and book the date. Please note, after 50% is paid, the remaining 50% needs to be paid before all the images are released. Once final payments are done, all the chosen & edited images will be provided, fully edited.

REFINED PHOTOGRAPHY PHOTO SHOOT AGREEMENT TERMS

Client is guaranteed their chosen hour/time which they have paid for, or time specified in the invoice for special occasions. The photographs will then be edited (allow 3 to 4 weeks for editing). Weddings may take up to 2-3 months.

IMPORTANT NOTICE

It is Refined Photography’s policy to never release any unedited or unchosen pictures in any form to anybody.

TRAVEL

All photography & videography packages include a 35 kilometer radius from Durbanville. Any shoot or booking outside this radius, will be charged accordingly. Please note, travel fees are calculated at R6,50 per kilometer, or R400 per hour for travel time.

CANCELLATION/POSTPONEMENT (where applicable)

The client understands that by entering into this agreement, RFND is foregoing other photographic appointments, or events. In the event of a cancellation or postponement of the photographic session/agreement by the client, the amounts paid are non-refundable. Deposits are transferable if a date change is necessary. A period of 72 hours’ notice of postponements or cancellation is applicable when booking for refunds.

WEATHER (WHERE APPLICABLE).

If it is not possible for shoot to take place on a scheduled day due to weather, RFND and the client will reschedule on an agreed date at the earliest date possible with no additional charge. As we have no control over weather, no extra charges will be made, unless in special circumstances. This refers to shoots that are far away, or shoots that have a large travel fee. Shoots outside of the Western-Cape or South-Africa require special arrangements.

COOPERATION | NO SHOWS

RFND is not responsible if the client and/or key individual fails (noted) to cooperate or appear during photo shoots, or for missed images due to details not revealed to RFND. If the client and/or key individuals fail to arrive to a scheduled photo shoot the full amount is non-refundable. The session can be rescheduled at the original photo shoot and a penalty fee of R550 will be charged.

RESHOOTS – CAMERA FAILURE OR EXPOSURE PROBLEMS

In the unlikely event that the finished product from a photo shoot is unusable due to technical problems, (camera failure or exposure problems), RFND will re-shoot at no additional charge in order to perfect the work. No photo session will be wrapped up if not satisfied (in the opinion of RFND and the client) and this is a strict policy. With data loss or camera failure, RFND is covered by insurance. Large waiting periods may apply in order to recover data or if RFND has to undergo any camera repair/replacement.

All images are copyrighted to and remain property of Refined Photography. As a registered business, Refined Photography has all the right to share any work done for any reason unless you require special arrangements to be made.

CLIENT’S USAGE

Client is obtaining prints for personal use only, and shall not sell said prints. Prints for publication (such as editorial, public relations or advertising use) require prior written consent from Refined Photography. A credit line that reads “Refined Photography” and our contact details in type no smaller than that of the related text must appear adjacent to or within all permitted published photographs. Written consents are free of cost, and they will be done within 12 hours after a request has been logged.

MODEL RELEASE

Client grants to Refined Photography and their legal representative and assigns, the irrevocable and unrestricted right to use and publish photographs of the client, client’s child or children, or in which the client may be included for editorial, trade, advertising and other related purposes, and in any other manner and medium; to alter the same without restriction; and to copyright the same. Client hereby releases Refined and their legal representative and assigns from all claims and liability relating to said photographs. This includes displaying photographs on stock websites, like Shutterstock.

SHOULD the client wish to not have certain photographs published, an arrangement may be set up separately to accommodate for the requirement of the client at no extra charge, only if a valid reason is provided.

EXHIBITION

Client grants Refined Photography permission to display selected images resulting from this assignment as an example of Refined`s work and for entrance into photographic competitions, should the occasion arise, and releases all claims to profits that may arise from use of.

GEAR SAFETY AND INSURANCE FOR REFINED PHOTOGRAPHY, REALTY, MEDIA & VIPER

Should any person damage any of the gear/equipment owned or rented by Refined Photography, that person will be held liable for any damage/repair/insurance fees. This includes any person present at the event or shoot that was booked, and does not reflect directly on the client, only to the specific person who caused the damage. By signing this agreement clients do accept and agree to assist in these matters.

LIMIT OF LIABILITY

I, Julius Bekker, take the utmost care with respect to exposure, retouching, and transportation of digital captures, proofs and prints. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond my control, Refined Photography`s liability is limited to the refund of all payments received, or a re-shoot can be scheduled at no additional cost. The limit of liability for partial loss or damage of originals shall be a pro rata amount of the initial total amount, based on the percentage of the originals lost or damaged. In the unlikely event that I, Julius Bekker, am injured or become too ill to attend to the photo shoot, Refined Photography shall make every effort to reschedule to the earliest possible date.

CHANGES TO THIS AGREEMENT

There may be additional charges if changes are made to this agreement. Client may increase the period of Refined`s service on the shoot date, provided Refined is available during the time requested. Added expenses resulting from such change, including additional service cost, digital capture costs, and change-related fees will be added on to the final balance and will be paid in full by client prior to delivery or release of the photos.

Client may not decrease the period of Refined’s service on the photo date. If the period of Refined’s services is cut short by reason of fire, casualty, death, act of God or other cause beyond the control of the parties, Refined Photography shall still receive the total fees. These terms are not exhaustive and Refined Photography retains right to change without prior notice or consent at its own discretion.
